The Bribery Act 2010: Philosophy, Law & Policy

The Bribery Act 2010 makes a number of important changes to the way in which bribery is tackled through the criminal law. The Act collapses the distinction between public and private sector bribery, and abandons an approach to private sector bribery based on civil law concepts such as breach of an agent's duty to his or her principal. The Act extends the reach of bribery in respect of bribes offered by companies overseas. Most controversially, it creates a new-style criminal offence, applicable to companies, of 'failing to prevent' bribery. How significant are these changes likely to prove in practice? Is there a coherent philosophy behind the new approach? These are some of the questions to be addressed in the course of this talk.
