Neighbour Law

The property law discussion group will be hosting a talk by Professor Andre Van der Walt of Stellenbosch University on “Neighbour law”, a topic which will span public, private and property law themes, and which we hope will be of interest to public, private and property lawyers alike. The central question, "What does it mean to live together as neighbours?" is one which raises important questions of both public and private law: How does the requirement of the South African constitution to promote the spirit and objects of the constitution affect the development of the common law of neighbours? Does the constitutional perspective bring anything new to the existing private-law centred debates? How do private law concepts of "normal use" "reasonableness" and “rights” to light or a view fit in to the rapidly developing constitutional jurisprudence? The talk and discussion will take place in the St Cross SCR from 1pm. A sandwich lunch and refreshments will be provided from 12.45pm. All faculty members and graduate students (including BCL/MJur students) are invited. The discussion especially will be particularly worthwhile if participants bring to it a mixture of public and private law perspectives.
