Responsible Lending

The ‘subprime mortgage crisis’ has taught us different lessons. One of those lessons is certainly to rethink lending practices to people on low income and to elaborate on possible regulatory responses to over-indebtedness. The paper is aimed at discussing whether or not irresponsible lending and/or irresponsible borrowing are a reality, whether regulation against over-indebtedness is needed and what kind of methods of preventing over-indebtedness might have a chance of success. Special emphasis shall be given to the concept of ‘duty of responsible lending’ as well as possible sanctions of neglecting such duty.
