The Scope of Conversion: Property and Contract

In their dissenting judgements in OBG Ltd v Allan [2008] 1 AC 1, Lord Nicholls and Baroness Hale argued that the tort of conversion should be expanded so as to protect contractual rights as well as chattels. The property law discussion group will be hosting a talk by Simon Douglas on the difficult questions concerning the boundary between property and contract raised by these arguments. Is a contractual right a form of ‘property’? If not, should it be protected in the same way as property? Does the fact that much wealth is now stored in contractual rights rather than in chattels and land make the division between property and contract redundant?
