The Fiction of the Constructive Trust

The Property Law Discussion Group will be hosting a discussion of Bill Swadling's recent Current Legal Problems lecture, 'The Fiction of the Constructive Trust', which argues that 'constructive trusts' have no affinity with genuine trusts arising by the declaration of a settlor. Instead, both the genuine trust and the material found under the 'constructive trust' heading in the trusts books will only be properly understood once the two are decoupled and the fiction of the 'constructive trust' laid bare.
