Causation and damages in pre-contractual liability for breaking off negotiations

The seminar will deal with the issue of damages in pre-contractual liability for breaking off negotiations. More specifically, it will tackle the distinction between reliance and expectation damages, the relations between fault on the side of the defendant and recoverable damages, as well as the exceptions to the general rule limiting damages to reliance interests (e.g. government liability in public procurement law). Although the major focus of the seminar will be on Italian law, references will also be made to recent developments in French law.
