A Statutory Duty of Good Faith in the Employment Relationship

Dr. Gordon Anderson, Professor of Law, Victoria University of Wellington, New Zealand and MacCormick Fellow, School of Law, University of Edinburgh (July 2010 to January 2011) will make a presentation on  "A Statutory Duty of Good Faith in the Employment Relationship". In particular, he will talk about the extent to which a mutual requirement of good faith can be found in employment relationships is an indicator of the extent to which the legal paradigm of employment has, or has not, developed over time.  In 2000 New Zealand introduced a broad statutory duty of good faith applying to the all facets of the employment relationship. This seminar will consider the legal antecedents of that duty, such as the common law implied term of mutual trust and confidence, and the impact of the statutory term in practice. A light lunch will be provided.
