The ‘Objectives’ and ‘Principles’ of the TRIPS Agreement: express recognition and increasing relevance beyond the WTO

Articles 7 (Objectives) and 8 (Principles)of the TRIPS Agreement are regarded by many commentators and national diplomatic representatives as important tools that seek to preserve public interest flexibilities, maintain the policy space of Member States, and demonstrate that a balanced development perspective is an important, yet often overlooked, aspect of the TRIPS Agreement. These provisions have influenced development gains within the WTO through the Doha Ministerial Declaration and the Declaration on TRIPS and Public Health. However, more recently they have become key elements in the area of enforcement for both the WIPO Development Agenda and the Anti-Counterfeiting Trade Agreement (ACTA). The focus of the presentation will be upon the implications the wider use of Articles 7 and 8 has for their future practical and legal application. The potential exists for both Articles 7 and 8 to be recognised as fundamental principles of international intellectual property enforcement that link regimes and fora to influence the application and interpretation of regulation in this area.
