Intellectual Property enforcement: The practical side of IP rights

This talk will provide a whistle-stop review of some of the issues that arise when enforcing IP rights in practice. We will consider the importance of full investigation and securing test purchases as well as the problems associated with litigants in person including the potential difficulty of enforcing a court order (e.g. Westwood v Knight [2012] EWPCC 14). We will briefly consider the different venues and the impact that the Patents County Court has had and will continue to have on smaller IP claims in England and Wales.
The talk will consider alternative non-litigious means of enforcing rights such as approaching the ISPs or payment providers in relation to websites. Finally, we will consider the extent to which the law is needed at all thanks to the role that social media can play in spreading awareness of both enforcement action and putting pressure on more reputable organisations to 'play by the rules'.
