The Nature of Rationality Review

Debates concerning proportionality and rationality have brought into sharper focus the meaning of both concepts. It nonetheless remains the case that the very meaning of rationality within judicial review remains under-theorized and imperfectly understood, with the consequence that erroneous conclusions are drawn regarding issues central to the concept. This discussion seeks to sharpen our understanding of rationality review and to dispel some of the misunderstandings that surround the concept.
