Environmental Cases involving Scientific Evidence in the International Court of Justice
Speaker: Dr Caroline Foster, University of Auckland
Venue: Corpus Christi College Fraenkel Room
Dr. Caroline Foster will discuss how the Court may deal most effectively with environmental cases requiring scientific evidence, with reference to cases currently on the Court's docket including Whaling in the Antarctic (Australia v. Japan)and Aerial Herbicide Spraying (Ecuador v. Colombia). Dr Foster will build on the discussions in her book, Science and the Precautionary Principle in International Courts and Tribunals: Expert Evidence, Burden of Proof and Finality (Cambridge University Press, 2011). She will consider matters including whether the Court should be more ready to appoint independent experts to assist it with complex cases, and how their consultation might be structured, with reference to the practice of other international courts and tribunals."
