Supranational Review of Domestic Courts in NAFTA

Speaker: Professor Jay Westbrook, University of Texas at Austin

The growth of supranational judicial institutions and procedures may be an inevitable result of globalization, yet this development has received relatively little attention in North America despite the emerging reality of supranational judicial review of actions taken by domestic courts in the NAFTA countries. Although NAFTA does not approach the degree of legal unity and uniformity achieved within the EU, some of its provisions for review of governmental actions may be more intrusive. It would be interesting to generate some useful dialogue in comparing developments in NAFTA and the EU and discussing their implications.
