Fundamental Conceptions of the Basis of Civil Liability: Insights from the Draft Hungarian Civil Code

Section 339 of the existing Hungarian Civil Code states: "A person who causes damage to another person in violation of the law shall be liable for such damage. He shall be relieved of liability if he is able to prove that he has acted in a manner that can generally be expected in the given situation." This is a uniform rule applicable to both contractual and non-contractual liability and was considered a great achievement of the current code. However, on considering these matters for the new code, the view was taken that the conditions of liability should be different in the case of contract and of non-contractual liability and so the new code will differentiate between these situations. Dr Gárdos will explain the current rule, its problems and the new solution which will be proposed.
