The owner of the car was unknown. The judge had found that as C had known the car to be stolen, he was precluded from maintaining his claim to it. C argued that as a result of the Court of Appeals's judgment in Webb v Chief Constable of Merseyside [2000] Q.B. 427 in which it had been held that following the cessation of the right of the police to retain property, the person from whom it was seized was entitled to its return and the court was required to uphold his claim. CCD argued that as the car was stolen, the police became its possessory owners and had no obligation to restore it to C.
