Expressivism and Dignity in Law
Law is increasingly regulating actions for their expressive content. The symbolic meaning of flag burning, organ harvesting, defacing art, biotech patenting, wearing religious symbols in the work place have been important to debates over the legal regulation of these acts. Sometimes, these expressive concerns have piggybacked the ideal of human dignity. In this panel discussion,
- Alan Bogg will discuss the role and potential for expressivism in a worker's right to working conditions which respect dignity under Article 31 of the EU Charter of Fundamental Rights,
- Justine Pila will consider the expressive significance of copyright's prejudice against commercially-motivated uses of a work,
- Tarun Khaitan will discuss the role of expressivism in discrimination law.
