For all their centrality in any domestic copyright law, notions of work and authorship are hardly elaborated in the many EU directives on copyright. Has the Court of Justice really stepped in and created a pan-European notion of what constitutes a work? The recent Infopaq and BSA judgments suggest so. Will the upcoming judgment in the 'Fotos von der Front' case mark a similar step towards a harmonised concept of authorship? This seminar highlights some of the puzzles that would need to be solved.
