It has been suggested that legislation requiring the plain packaging of tobacco products expropriates the intellectual property rights of tobacco companies (particularly their trade mark rights). This paper considers whether or not the introduction of such legislation within Europe would violate the fundamental guarantee of (intellectual) property within the European legal order
