Duties and justification: a human rights duty on employers

This paper will investigate possible justifications for the imposition of a duty to respect the human rights of employees upon all employers, including those in the private sector. It will examine ideas such as the inequality of bargaining power; the risk of exploitation; the presence of control and subordination and the concept of interpersonal dependence to justify such a duty. It will assess the pitfalls of each concept and discuss which possibility is the most persuasive.
