The pandemic has disrupted the dispute resolution landscape worldwide. Brexit has brought additional complexities, especially for the UK. In this project, we explore ways of improving civil procedure rules in commercial matters in a post-Brexit and post-pandemic world. We argue that states have an ‘infrastructure responsibility’ to establish and maintain a functioning court system for commercial cases. We assess the (changing) dispute resolution preferences of stakeholders by a three-part strategy based on more than 20 structured interviews, an online survey and case studies of key reform events in select jurisdictions. Against this background, we suggest possible avenues for reform. These include making better use of new technologies.  Details of the project are described here.
