Judicial Early Neutral Evaluation

Dr Victoria McCloud’s paper ‘Judicial Early Neutral Evaluation’ was published in Amicus Curiae, Series 2, Vol 1, No 3, 497-510 today.

Abstract: In light of the recent judgment in Telecom Centre (UK) v Thomas Sanderson (Early Neutral Evaluation) (2020) the author provides a brief overview of some of the history and principles behind early neutral evaluation (ENE) and in particular 'judicial' ENE as understood in the Telecom judgment (reproduced in this edition).
