Andrew Higgins drafts report for Civil Justice Council on reforming Pre-Action Protocols

Andrew Higgins is currently chairing a review of pre-action protocols for the Civil Justice Council (The CJC). The CJC is a statutory independent advisory body, headed by the Master of the Rolls, which is responsible for overseeing and co-ordinating the modernisation of the civil justice system. There are currently 18 different pre-action protocols in force in England & Wales covering a wide range of litigation. The protocols outline the processes parties to a dispute are expected to follow before starting court proceedings.
The CJC working group recently published its Interim Report on potential reforms to PAPs with a view to making them more accessible and more effective in promoting consensual dispute resolution and proportionate litigation.
