The Judge and the Constitution: How to Fix the U.S. Constitution and the Supreme Court

Outline and Details
David H. Moskowitz joins us to discuss his book The Judge and the Constitution and the ideas that led him to question some of the most established assumptions about the U.S. Supreme Court and constitutional law.

His work asks a provocative question:

If we were designing the American constitutional system today, would we create the Supreme Court as it currently exists?

Moskowitz approaches that question through constitutional history, jurisprudence, comparative constitutional systems, and the philosophy of law. His project also draws on the work of legal philosophers including H.L.A. Hart and Hans Kelsen and engages with American Legal Realism.

What the author will explore

His proposal goes beyond simply criticizing individual Supreme Court decisions. Moskowitz asks whether the institution itself should be redesigned, including consideration of a separate constitutional court, term limits, judicial selection, ethics and recusal rules, and clearer standards for constitutional decision-making.

Why attend?

This is an opportunity to do something different from simply reading and discussing a book: question the author himself.
Students will be able to hear how Moskowitz developed his argument, examine the legal and philosophical ideas behind it, and challenge his proposed reforms.

You do not need to agree with the author. In fact, disagreement should make the conversation more interesting.

A conversation, not just a lecture

The aim of the session is to bring students into direct conversation with an author proposing significant changes to one of the most powerful institutions in American government.

Read the argument. Hear the author make his case. Then challenge him.

A complimentary lunch will be provided for all attendees.
