Administrative prevention: A novel approach in administrative law

Administrative law has been deeply impacted by the constitutional dimension of the treaties of human rights, in particular in those countries that belong to the Inter-american System of Human Rights. The conventionality control (created by the Inter-american Court of Human Rights) measures the compatibility of internal norms with those concerning human rights. It  interacts with constitutional control. This marks the birth of a new function; that of administrative prevention by the Public Administrations, a function deriving from the general duty of guarantee. I shall argue that it can be extended beyond human rights, into other areas of administrative law.
